Potential client (dad) received notice from the Chapter 7 trustee asking dad to return $15,000 that daughter (debtor) paid to dad six months before filing her petition. Daughter used a convenience check from her credit card to pay a debt she owed to dad. Dad does not have the money. It does not appear any of the exceptions to section 547 apply. Dad needs to negotiate a deal with the trustee, let him take a default
judgment, or file bankruptcy himself. The trustee doesn’t want a valueless uncollectible judgment, so as with any creditor, demonstrating an inability to pay should get him a
deal.
